Where UK cannabis legalisation actually stands, September 2026

Every week someone asks us the same question: so when does this actually become legal?

Here is where things genuinely stand, without the hype.

The law today

Cannabis is a Class B drug. Possession can mean up to five years; supply up to fourteen. Medical cannabis has been legal by prescription since November 2018, but NHS prescriptions remain vanishingly rare - most patients who use it legally go private.

Psilocybin, the active compound in magic mushrooms, sits in Class A, the most restricted tier. That puts it further from legal access than cannabis, even though the research case is arguably stronger.

What is actually moving

Three things worth watching:

1. London's drugs commission. The Mayor's office has kept decriminalisation on the agenda, and the London Drugs Commission's recommendations have pushed the conversation from "if" toward "how".
2. Medical access widening. Private cannabis clinics have grown year on year since 2018. Each one normalises the idea that adults use cannabis responsibly.
3. Psilocybin research. UK universities are running serious clinical trials for depression and PTSD. Rescheduling for medical use is a live policy question, not a fantasy.

None of this means shops open next month. It does mean the direction of travel is real.

What a legal market would look like

If the UK follows the countries that have gone first - Canada, Germany, parts of the US - expect licensed premises, age verification, tested product, and taxes funding public services. The unregulated market does none of that.
